Scope and acceptance

By accessing or using this website, you agree to these Website Terms. If you use the website for a company or other organisation, you confirm that you are authorised to act for it and that “you” includes that organisation. If you do not agree, do not use the website.

The website is intended for manufacturers, formulators, brand owners, distributors, researchers and other professional users. It is not a consumer shop, does not provide consumer medical advice and does not allow an order to be placed or a contract to be concluded online.

Website and product information

General information only

Website content describes HETCHYN, ingredient formats, available or custom product codes, typical specifications, applications, research and quality systems at a general level. We take reasonable care when preparing it, but product information may be summarised, updated, incomplete or subject to qualification. Images are illustrative and may not reproduce a product's exact colour, texture, packaging or batch appearance.

Document priority

For a particular purchase, the following order generally applies unless the parties agree otherwise in writing:

A representative COA shows results for the stated batch and is not a guarantee that every batch will have identical results. A specification limit is distinct from a representative batch result. Total arsenic and inorganic arsenic are different parameters and should not be treated as interchangeable. Website certificate images may carry a watermark and are provided for preview; request a current approved copy for qualification or regulatory use.

Availability and changes

Product availability, capacity, lead time, stock indicators, potency, composition, testing, packaging and regulatory status can change. We may correct errors or revise website content at any time. Please ask sales and quality teams to confirm the current grade, documents and availability before relying on them.

Inquiries, quotations and contracts

No website offer

Website content, sample information, indicated minimum order quantities and responses to preliminary questions are invitations to discuss business. They are not binding offers, guarantees of supply or reservations of inventory. Sending an inquiry does not require either party to proceed.

Contract formation

A sale becomes binding only when HETCHYN issues or accepts a written quotation, order confirmation or supply agreement through an authorised representative and any stated conditions are met. Purchase-order terms supplied by a customer do not amend or replace HETCHYN's terms merely because they are received, acknowledged or referenced, unless HETCHYN expressly accepts them in writing.

Commercial details

Final price, currency, taxes, minimum order quantity, sample charges, packaging, payment terms, shipment date, delivery term, Incoterms® rule, insurance and title or risk transfer are set out in the applicable quotation or agreement. Estimates remain subject to production planning, raw-material availability, compliance review and credit approval. Unless expressly stated, website prices or quantities do not include taxes, duties, customs fees, freight, insurance or local testing and registration costs.

Cancellations and force majeure

Cancellation, return, rejection, recall and warranty procedures are governed by the applicable transaction documents. Neither party is responsible for delay or failure caused by events outside its reasonable control to the extent provided in the governing contract and applicable law, including natural events, epidemic controls, government action, transport interruption, utility failure, labour disruption or shortage of critical inputs.

Customer responsibilities

Suitability and formulation

You are responsible for assessing whether an ingredient, grade and delivery format are suitable for your formulation, process, packaging, storage conditions and intended shelf life. Typical applications are examples, not guarantees of performance. Appropriate bench, pilot, stability, compatibility and finished-product testing must be completed by or for the customer.

Regulatory and claims review

You are responsible for confirming the legal status, permitted use level, product category, import requirements, registration, labelling, allergen statements, warnings, claims and advertising rules applicable to your finished product and target market. GRAS status or another certificate applies only to the named product, scope and conditions described in the applicable document; it does not automatically approve a customer's finished product or marketing claim.

No medical advice

Research summaries and scientific references are provided for professional evaluation. They do not diagnose, treat, cure or prevent disease, do not establish clinical efficacy for a finished product, and do not replace advice from qualified medical, scientific, regulatory or legal professionals. You must not present HETCHYN website content in a way that creates an unauthorised medical or health claim.

Trade and ethical compliance

You must comply with applicable import, export-control, sanctions, customs, anti-bribery, anti-money-laundering and competition laws. You must not request, purchase, divert, resell or use products in a prohibited jurisdiction, for a prohibited person, or for an unlawful purpose. HETCHYN may pause or decline an inquiry while performing compliance, identity, destination or end-use checks.

Documents, samples and confidentiality

Public website materials may be used internally to evaluate a potential business relationship. Current approved Product Specifications, COAs, SDS / MSDS files, certificate copies, audit information and other controlled records must be requested from HETCHYN sales or quality personnel. We may require company identification, project information, a confidentiality agreement or other qualification before providing certain documents or samples.

Samples are supplied solely for evaluation under the accompanying instructions and are not for consumer sale, human administration or use outside their identified purpose unless expressly authorised in writing. Sample characteristics may differ from later commercial batches within the agreed specification.

If information is marked confidential or is confidential by its nature, the recipient must protect it, use it only for the agreed evaluation or transaction, and disclose it only to personnel and advisers who need it and are bound by equivalent duties. A separate non-disclosure agreement controls if one applies.

Acceptable use and intellectual property

HETCHYN or its licensors own the website, its original text, layouts, graphics, photographs, video, downloads, product names, logos and other brand materials. Dunaliella salina scientific names and third-party marks remain the property of their respective owners. No right or licence is granted except the limited permission to access the website and make reasonable internal copies for genuine product evaluation.

Without prior written permission, you must not:

• republish, sell, sublicense or commercially exploit substantial website content or HETCHYN brand materials;
• alter a certificate, COA, specification, watermark or other controlled document;
• suggest that HETCHYN endorses your company, product, formulation or claims;
• use automated means to scrape, harvest or overload the site, except ordinary indexing by legitimate search engines;
• circumvent security, test vulnerabilities without authorisation, introduce malicious code or interfere with operation; or
• use the website or its content for fraud, unlawful competition, misleading advertising or any illegal purpose.

If you send feedback or a non-confidential suggestion about the website, you allow us to use it without restriction or payment. This does not give us ownership of your confidential formulation, customer data or other proprietary information.

Third-party links and references

Links to journals, registries, regulators and third-party websites are provided for convenience and source access. HETCHYN does not control their availability, security, content or privacy practices. A link does not imply endorsement. Access is at your discretion and subject to the third party's terms.

Disclaimers and liability

The website is provided on an “as available” basis. To the fullest extent permitted by law, HETCHYN excludes implied warranties relating to the website, including uninterrupted availability, freedom from error, fitness for a particular purpose and non-infringement. Nothing in these Terms creates a product warranty beyond the express warranty, if any, in the applicable written transaction documents.

To the fullest extent permitted by law, HETCHYN is not liable for indirect, incidental, special, punitive or consequential loss arising from website use, or for loss of profit, revenue, opportunity, goodwill, anticipated savings or data. This includes loss caused by reliance on preliminary website information instead of the current agreed specification, batch documentation or written regulatory assessment.

Where liability connected only with website use cannot lawfully be excluded, HETCHYN's aggregate liability will be limited to the greater of the amount you paid specifically to access the website and USD 100. This website limitation does not replace a liability limit agreed for a product sale. Nothing excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any liability that applicable law does not permit a party to exclude or limit.

Our Privacy Policy explains how personal information associated with website use and inquiries is handled.

Changes, suspension and availability

We may update these Terms or change, suspend or withdraw part of the website. The effective date above identifies the current version. Continued use after an update means you accept the revised Terms to the extent permitted by law. We do not guarantee that the website or any content will remain available in every country or at all times.

Governing law and disputes

Unless mandatory law requires otherwise, these Terms and any non-contractual dispute arising solely from use of the website are governed by the laws of the People's Republic of China, without regard to conflict-of-law rules. Courts with jurisdiction at HETCHYN's registered place in Zhejiang, China have exclusive jurisdiction. A quotation, order confirmation or supply agreement may specify a different law or dispute forum and will control the relevant transaction.

Severability, waiver and assignment

If a provision is held unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary and the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not assign rights under these Terms without our written consent; HETCHYN may assign them in connection with a reorganisation, asset transfer or change of control.
